Terms of Service

By creating an account, accessing, or using any part of AfterGlow, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Infernite.

We reserve the right to update these Terms at any time. Material changes will be communicated via email or an in-app notice. Your continued use of the platform after the effective date of the revised Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using AfterGlow.

AfterGlow is an AI-powered creator operating system that enables content creators and businesses to:

• Generate scripts, captions, and creative content using AI models
• Create and manage visual assets and video content
• Schedule and publish content to connected social platforms (YouTube, LinkedIn, Instagram)
• Manage comments and replies across connected platforms via a unified inbox
• Analyse content performance and audience engagement patterns
• Connect external tools including Canva and Google Drive

Features and functionality are subject to change. We may add, modify, or discontinue features at any time with or without prior notice.

You must be at least 16 years of age to use AfterGlow. By using the platform you represent and warrant that:

• You are at least 16 years old
• You have the legal capacity to enter into a binding contract
• Your use of AfterGlow does not violate any applicable law or regulation
• You are not located in a country subject to applicable trade sanctions or embargoes

If you are using AfterGlow on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

To access AfterGlow you must create an account using a valid email address via Google OAuth (powered by Supabase Auth). You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information as necessary
• Keep your login credentials confidential and not share them with third parties
• Notify us immediately at cbo@infernite.co.in of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that we determine, in our sole discretion, violate these Terms or pose a security risk.

5.1 Subscription Plans

AfterGlow offers tiered subscription plans (Free, Standard, Pro). Each plan grants access to specific features and a monthly credit allowance. The specific entitlements for each plan are described on our Pricing page and are subject to change with reasonable notice.

5.2 Credit System

Certain AI-powered features consume credits. Credits are deducted upon use and do not roll over between billing periods unless otherwise stated. We reserve the right to adjust credit costs for specific features with advance notice. Credits have no monetary value and cannot be exchanged for cash.

5.3 Billing & Payments

Paid subscriptions are billed on a recurring basis (monthly or annually) through Razorpay. By subscribing you authorise us to charge your payment method on the applicable billing cycle. All amounts are in Indian Rupees (INR) unless stated otherwise. Prices are inclusive of applicable taxes where required by law.

5.4 Refunds

Subscription fees are non-refundable except where required by applicable law or as explicitly stated in a specific promotion. If you cancel a paid subscription, you will retain access to paid features until the end of the current billing period. We do not offer prorated refunds for partial billing periods.

5.5 Plan Changes & Cancellation

You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Downgrades take effect at the next billing cycle. Cancellation stops future charges; it does not entitle you to a refund of the current period.

5.6 Failed Payments

If a payment fails, we may attempt to reprocess the charge. If payment remains unsuccessful after reasonable attempts, your account may be downgraded to the Free plan and access to paid features suspended until payment is resolved.

You agree to use AfterGlow only for lawful purposes and in accordance with these Terms. You must not use AfterGlow to:

• Violate any local, national, or international law or regulation
• Generate, publish, or distribute content that is defamatory, obscene, hateful, or infringes the rights of any third party
• Harass, threaten, abuse, or harm any individual or group
• Generate spam, unsolicited communications, or mass commercial messaging
• Attempt to gain unauthorised access to our systems, other user accounts, or third-party platforms
• Reverse-engineer, decompile, or disassemble any part of AfterGlow
• Use automated scripts, bots, or scrapers to access or collect data from AfterGlow without our written consent
• Impersonate any person, entity, or organisation
• Upload or transmit malware, viruses, or any malicious code
• Circumvent, disable, or interfere with security or rate-limiting features of the platform

Violation of this policy may result in immediate suspension or termination of your account without refund.

7.1 Our Intellectual Property

All rights, title, and interest in and to AfterGlow, including its software, design, trademarks, logos, and documentation, are and remain the exclusive property of Infernite. These Terms do not grant you any ownership rights. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use AfterGlow solely for your personal or internal business purposes in accordance with these Terms.

7.2 Your Content

You retain all ownership rights to the original content you create using AfterGlow (“Your Content”). By using the platform you grant Infernite a limited, non-exclusive, royalty-free licence to store, process, and transmit Your Content solely as necessary to provide the service. We do not claim ownership of Your Content and will not use it for any purpose other than operating AfterGlow.

7.3 AI-Generated Content

Content generated by AI models within AfterGlow is provided to you for your use. Ownership and rights to AI-generated outputs may be subject to the terms of the underlying AI providers and applicable law, which is evolving. You are responsible for ensuring that your use of AI-generated content complies with applicable laws and platform policies.

7.4 Feedback

If you provide feedback, suggestions, or ideas about AfterGlow, you grant us an irrevocable, perpetual, royalty-free licence to use such feedback without obligation or compensation to you.

By connecting your social and third-party accounts (YouTube, LinkedIn, Instagram, Canva, Google Drive) you agree to the applicable terms of those platforms in addition to these Terms. You represent that:

• You have the authority to connect the relevant accounts and grant us the access scopes you approve
• Your use of connected platforms via AfterGlow complies with each platform’s terms of service and community guidelines
• You will not use AfterGlow to violate any platform’s policies, including by automating actions that are prohibited by those platforms

We are not affiliated with, endorsed by, or responsible for any third-party platform. We are not liable for any changes to third-party APIs or policies that affect AfterGlow’s functionality.

AI-generated content produced by AfterGlow may be inaccurate, incomplete, or inappropriate for certain audiences. You acknowledge that:

• AI outputs are not professional advice (legal, financial, medical, or otherwise)
• You are solely responsible for reviewing and approving AI-generated content before publishing
• We make no representations regarding the accuracy, originality, or fitness for purpose of AI-generated content
• You bear full responsibility for any content published to your platforms using AfterGlow

Important — please read carefully

AfterGlow is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Infernite expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the platform will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any content or results obtained through the platform

We do not warrant that defects will be corrected or that the platform is free from viruses or other harmful components.

Important — please read carefully

To the maximum extent permitted by applicable law, in no event shall Infernite, its directors, employees, partners, agents, or licensors be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from unauthorised access to or alteration of your data
• Damages arising from the conduct of third parties, including connected social platforms

Regardless of the form of action, Infernite’s total aggregate liability to you for all claims arising from or relating to these Terms or your use of AfterGlow shall not exceed the greater of: (a) the amount you paid to Infernite in the 12 months preceding the claim, or (b) INR 1,000.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Infernite and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of AfterGlow or any content you create, submit, or publish
• Your violation of these Terms or any applicable law
• Your violation of any third-party right, including intellectual property or privacy rights

13.1 By You

You may terminate your account at any time by contacting us at cbo@infernite.co.in or through your account settings. Upon termination, your right to use AfterGlow ceases immediately.

13.2 By Us

We reserve the right to suspend or terminate your account and access to AfterGlow at any time, with or without cause, including for violation of these Terms. We will endeavour to provide reasonable notice except where immediate termination is required for security or legal reasons.

13.3 Effect of Termination

Upon termination, all licences granted to you under these Terms immediately expire. Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will remain in full force.

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

14.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or in connection with these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiations for a period of 30 days.

14.3 Jurisdiction

If a dispute cannot be resolved through negotiation, both parties irrevocably submit to the exclusive jurisdiction of the competent courts located in India. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief in any appropriate jurisdiction.

Entire Agreement

These Terms, together with the Privacy Policy and any additional terms specific to certain features, constitute the entire agreement between you and Infernite regarding AfterGlow and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

Waiver

Failure by Infernite to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. Infernite may freely assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure

Infernite shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including acts of God, governmental actions, internet service disruptions, or third-party platform outages.
